Video Podcast – I’m Dreamin of an End to DACA

by: the Common Constitutionalist

Today I discuss DACA, the Deferred Action for Childhood Arrivals program.

President Trump has plans to end Obama’s signature program this Tuesday. Let’s hope he does. I explain why DACA is unfair to Americans and frankly is illegal and unconstitutional. Recall that the program was cooked up and sent out as a memo, called an Executive Action.

I also discuss Florida Governor Rick Scott’s convoluted position in favoring the DACA program. He wants to make the Dream Act permanent. Good for him – NOT. read more

Texas Beats Obama on Illegal Immigration

The good guys finally won one! Well – kind of. We have at least temporarily beaten back the Obama forces of evil – the pro-illegal alien crowd.

To further clarify, we didn’t actually do anything. The supreme Court, with is deadlocked eight current members, did the job for us.

Yesterday, the eight member court failed to muster a majority of votes to rehear the case concerning Obama’s stalled Deferred Action for Childhood Arrivals (DACA) amnesty scheme.

To review, DACA was illegally decreed by Obama in June of 2012. It allows that illegal immigrants who came to the United States as children and meet several guidelines may request consideration of deferred action for a period of two years, subject to renewal. They are also eligible for work authorization. In other words, call it what they will – but it’s ultimately a form of amnesty. read more

Illegal Alien Gets a Free Education

by: the Common Constitutionalist

Short of buying a house, paying for college is the number one expense any American will incur in our lifetimes. And today some Ivy League and specialty universities can run well above what the average home might cost.

I have a personal friend whose son is attending one of these universities which cater to a special type of science and engineering for which the tab is around $70,000 per year. This poor kid will be paying off his student loans until he retires. This may be a slight exaggeration, but only slight.

Sure, he was able to apply for and receive some assistance in the form of grants through the school, but it doesn’t amount to much, relative to the overall expense.

So when I read this, I about fell out of my seat. CNS reports that, “Sarah Espinoza Salamanca found it hard to find money for college after graduating from North Hollywood high school in Southern California. She was brought to the state illegally from Mexico by her parents when she was four, but following a free K-12 education, she faced paying tuition for college – something she could not afford.” read more

Dick Durbin; The Dreamer

from:   at TheBlaze:

Update: It’s Friday morning and efforts by TheBlaze to extract an official response on this story from Senator Durbin are ongoing. As of 10:15 ET, there has been no official statement released from the senator’s offices.

It has been two days since a rather unflattering story broke about Alaa Mukahhal, one of Senator Dick Durbin’s “Dream Act” poster children. His website also refers to them as “American Dreamers” and highlights their stories online.

In those two days, the offensive Facebook pages of Alaa Mukahhal have been scrubbed and Senator Durbin has managed to duck or avoid TheBlaze’s efforts to secure a comment on her offensive actions and words.

Before 10 a.m. on Thursday, TheBlaze tried contacting Sen. Durbin’s office in Washington, D.C. In our first request to speak with the senator’s press secretary, we were hung up on. Additional requests for a connection to the lawmaker’s press secretary, Maria McElwain, via a cellphone or email address were not honored. No calls have been returned. read more

Obama on ICE

 by: the Common Constitutionalist

Late last summer 10 Immigration and Customs Enforcement (ICE) agents filed a federal lawsuit against the Department of Homeland Security (DHS).

What did the lawsuit pertain to, you may ask? Might it have been a workplace incident such as sexual harassment? Maybe they filed suit over unsafe working conditions or unfair Illegaladvancement procedures. No? ICE works with illegal aliens and border security. It must be that they’re being forced to be too hard on and are trampling on the rights of undocumented would-be citizens. That’s not it either?

Simply put, the suit the agents filed against the DHS and the Obama administration is to just maintain their right to uphold the law.

If you recall, last summer, when Obama realized that the “Dream Act” legislation would fail to pass proper legislative muster, he simply did what any right-thinking monarch would do; write an executive order preventing the arrest and deportation of illegals under 30 years of age. It was amnesty by dictatorial Fiat and in practice would extend to all illegals other than violent offenders.

ClintonThe ICE agents union president, Chris Crane, contends correctly, that the decree prevents agents from fulfilling their sworn oath to uphold the law and defend the United States Constitution; upholding laws such as the one passed in 1996 and signed by our first black president Bill Clinton, making it mandatory that all illegal aliens be deported.

Crane said, “The president’s Directive instructs ICE agents to refrain from placing certain aliens who are unlawfully present in the United States into removal procedures. The Directive further instructs officers to take actions to facilitate the granting of deferred action to aliens who are unlawfully present in the United States. It also directs DHS personnel to grant employment authorization to certain beneficiaries of the Directive.”

Mr. Crane further explains, “The directive commands our agents to violate federal law and our oaths to uphold federal law. We are federal law enforcement officers who are being ordered to break the law. This directive puts ICE agents and officers in a horrible position. This administration has engaged in a sustained, relentless effort to undermine America’s immigration laws.” Chris Crane knows of what he speaks, for he is not only the union president but also a veteran ICE agent. He has been on the front lines.

Former police commander David Scher added, “Sec. of Homeland security Janet Napolitano and her underlings want their agents and officers to just take the word of an illegal alien without verifying his or her statement. It is as ridiculous as releasing a suspected bank robber who states he didn’t commit the robbery without any verification by police officers.”

“The Directive is an extension of the DREAM act, which repeatedly failed to pass through Congress, and aims to grant an amnesty to 1.7 million illegal aliens,” said Chris Kobach, the attorney for the plaintiffs. “It violates federal immigration laws that require certain aliens to be placed in removal proceedings, it violates the Administration Procedure Act, and it encroaches upon the legislative powers of Congress as defined in Article I of the United States Constitution.”ice-agents

Encroaches? It stomps all over the constitutionally mandated authority of the Congress to pass laws.

“Any threat of harm to our nation’s immigration officers for enforcing the law is a threat against the livelihoods of average American workers,” said Roy Beck of NumbersUSA. “Congress passes laws to determine how many and which citizens of other countries are allowed to enter U.S. job markets to compete with American workers. Fortunately during this long period of high unemployment, Congress has refused to add further competition through amnesties that would give millions of illegal aliens access to the legal U.S. job market. The Napolitano amnesty directive does the opposite. If immigration agents are not allowed to enforce the laws as decided by Congress, the wages and jobs of American workers are at risk.”

In my humble opinion, this is where we on the right get hung up. As with every issue, the left deals and pure emotion and we allow it. We permit the argument to be driven by the left and their emotional response to everything. They set the tone of the discussion and the right falls dutifully on the defensive.

Rather, the right or true constitutional conservatives must reject the premise and merely insist on upholding the guiding principles of this country.

It simply doesn’t matter whether the dictate is considered fair to workers and their jobs. The Constitution is quite clear on who makes the law and who simply signs it. Congress makes DREAM actthe law and the president is duty bound to uphold and forced the law, period. If they don’t like it, they may attempt to amend the Constitution, which is been done many times. This is what should be argued, and only this. Everything else is just window dressing.

After many months there is an update to this story. Recently, federal District Court Judge Reed O’Connor ruled that the 10 agents and officers have standing to challenge Obama’s “Dream” decree in federal court.

There is something seriously wrong when federal agents have to go to court for the right to do their jobs and demand that they not be ordered to violate federal law.

With any luck, and strict constructionist judges, the agents will win the day.

Dream Act Lite

by: the Common Constitutionalist

So the other day, while I was a work, a young man broke into my house.

He was still there, eating a sandwich and watching MSNBC when I got home.

Needless to say, I was rather surprised to find this interloper sprawled out on my couch.

Since he looked as if he belonged, I made him a deal. He could stay in my home if he either went to college or joined the military. Stunning I know, but I am nothing if not generous.

Well, that didn’t really happen, but that is exactly what a couple of moderate Republican senators are proposing with the introduction of their own version of the “Dream Act”, granting young illegals, legal status.

Senators Jon Kyl of Arizona and Kay Bailey Hutchison of Texas claim they “have to get the ball rolling”.

Really. Why is that? Why again do we have to curry favor with those who broke into our country?

The two also claimed, “We have to have a discussion that is sensible, that is calm”.

Again, really? With whom will we have this calm and sensible discussion; the Democrats, La Raza?

The proposal is said not to be as far reaching as the democrat bill.  Well that’s fabulous. Once again, democrat-lite is supposed to be palatable.

They would reward those earning a college degree or completing military service, a fast track to a permanent visa, but claim that wouldn’t put them on the citizenship fast track. I believe them, don’t you? After all, they are politicians.

As an aside, how does one get into college without a social security number? I recall having to have one. Certainly one may not enter the military without one. That I also know. If that is the case, where do they obtain them and who’s not checking to see they are either bogus or stolen? Just asking.

However, with this administration running things, I doubt either of those cases would be a problem.

And what of the thousand upon thousands of immigrants who decide to do the right thing and come through the front door? These are the real victims. Naturally they will be swept aside in order for the politicians to pander to the law-breakers. Sounds fair.

Why not fast track the legal immigrants and deport the criminals? Somehow, and I’m not sure how, that would be seen as heartless.

Both senators went on to claim their intention is not to have the illegals access welfare or other government handouts. May I see a show of hands for those who buy that statement? None? I thought not.

I’m sure that is not their intention, but when it happens, and you know it will…oh well.

The two moderates say they have been working on the bill with everyone’s favorite conservative and maverick, John McCain, as well as the new poster boy of Hispanic bridge building, Marco Rubio.

Although Rubio is working on his own illegal give away bill, he is supportive of the Kyl/Hutchison legislation.

So what is the point of this republican bill? What are they trying to prove by trotting out this farce?

Do they really believe the increasingly monolithic voting block of Latinos will jump off the democrat gravy train and board the GOP express? Could they really be that naïve?

The polls from the last election told them, clearly no. Latinos didn’t vote democrat for anything but the giveaways. It’s not the republican family or religious values, nor is it the supposed Hispanic work ethic.

Hispanics, like most other minority groups in this country are becoming victims; victims of an ever-increasing entitlement society.

Back before LBJ’s failed experiment, his “Great Society”, minorities, particularly blacks had a great work ethic, but thanks to generations of liberal democrat and progressive republican policy, that pride has been bled out of them, and it’s a damn shame.  They now no nothing but entitlement.

Sadly this country’s Hispanic population is fast traveling down the same road and now the Republicans are helping push the cart.
