The supreme Court has decided, because it feels like it, to once again overstep it’s constitutionally authorized duties and grant deported aliens the right of a new challenge to their original deportation.

22 years after a Columbian national was deported for a major drug offense the Supremes have decided he should get a new hearing. Sounds reasonable – right?

Another Trump Victory – Remain in Mexico Policy Stands

In an 8-1 decision with only the wise Latina dissenting. What a shocker!!

The Supreme Court handed President Donald Trump a win on Wednesday with a court order giving his administration a judicial green light to continue enforcement of its “Migrant Protection Protocols,” otherwise known as the “remain in Mexico” policy for the time being.

Last week, the Ninth Circuit Court of Appeals in San Francisco upheld a lower court’s decision blocking the policy from going into effect in Arizona and California — the two border states within its geographical jurisdiction.

That injunction was set to go into effect on Thursday, before the Supreme Court stepped in this week. read more

Senate GOP Still Hearts the Green Agenda

While there is no bipartisan clamor to use GOP Senate control to force votes on sanctuary cities, there is a rush to pass a bipartisan bill dumping more money into green energy programs. Some might have thought we were done with the green energy venture socialism after the Obama era of Solyndra scandals, but in Washington, both parties are addicted to corporate welfare. Hence the rush to pass S. 2657, the American Energy Innovation Act.

It’s hard to call this bill bipartisan, given that the lead GOP sponsor is Sen. Lisa Murkowski. Yet even after voting against Kavanaugh and flirting with support for impeachment, she seems to control the Senate floor agenda more than anyone pushing the Trump agenda on immigration. read more

On the Verge of Pandemic, Court Effectively Opens Border

Imagine you are a liberal judge on the federal bench. You know that the entire political system, which includes all three branches of government and both political parties, vests you with unlimited power to dictate policy with an injunction. Regardless of the law, Constitution, rules of standing for a judicial case, past and recent Supreme Court precedent, political fallout, or national security consequences, you can declare an opinion and have that policy unquestionably become “the law of the land.” Why wouldn’t you try your hand at being a judicial version of Kim Jong-un?

At some point, we should stop blaming the judges for legislating with impunity and start blaming the other branches for not only ceding that power, but actively giving effect to the judges’ usurpations of law.

President Trump told lawmakers that he will not support a long-term extension of key intelligence programs without reforms to the Foreign Intelligence Surveillance Court.

Trump held a private meeting with Attorney General William Bar, Republican members of Congress, and GOP leadership on Tuesday about extending provisions of the USA Freedom Act. The meeting was focused on discussing certain provisions of the law that expire on March 15, including surveillance of lone-wolf terrorists, roving wiretaps, and a program that permits requests for metadata from phone records. read more

The United States Supreme Court is the highest court in the land and as such, has a very important roll within one of the three branches of the federal government.

It also has very specific duties, which are clearly defined in our Constitution.

As commentator Daniel Horowitz points out, these duties are called original jurisdiction.

This original jurisdiction is spelled out in Article III, Section 2, Clause 1, which states, “The judicial Power [of the supreme Court] shall extend to all Cases affecting Ambassadors, other public Ministers and Consuls; – to all Cases of admiralty and maritime Jurisdiction; – to Controversies to which the United States shall be a Party; – to Controversies between two or more States. …” read more

The Second Circuit Court of Appeals ruled Wednesday that the Trump administration can withhold federal funds from sanctuary jurisdictions for refusing to cooperate with immigration authorities in a decision that will likely trigger a Supreme Court review.

A number of cities have challenged the Justice Department policy that would withhold federal law enforcement grants from cities that refuse to cooperate with illegal immigration enforcement. The Second Circuit ruled against New York City’s challenge to the policy, but three other appeals courts have upheld injunctions that required the Trump administration to disperse the contested funds. The split between the circuit courts increases the likelihood that the issue will ultimately be decided by the Supreme Court, as justices generally take cases featuring questions over which multiple courts disagree. read more

The whole lot of them have never been more radical then they are today. Andrew Cuomo: Criminals’ Best Friend

Thirty-five years ago, as a late teen, I came to New York to attend yeshiva.  As an avid follower of news and politics, I recall cringing every time I heard then–New York governor Mario Cuomo on the radio, as he pontificated on the issues of the day, spewing forth liberal platitudes as if they were divine truths that no one dare question, while failing to say anything of substance, as the state was falling apart.  It was a disgrace.

Seventeen years later, Cuomo’s son, Andrew, was sworn in as the 56th governor of New York.  Although none of my friends or family members voted for him, people commented at the time that Andrew Cuomo was better than his father — pro-business; anti-crime; not as politically correct; and willing to take on ultra-progressives, such as NYC mayor Bill de Blasio.  The crime rate in New York State was not escalating, the rate of businesses leaving the state was not increasing, and things seemed sort of OK for a state led by a Democrat (although issues of morality, with Cuomo’s infatuation with “gay pride” and his non-marital domestic relationship, left much to be desired). read more

The Department of Interior finalized a rule Thursday expanding drilling rights in Utah two years after President Donald Trump reduced the size of a pair of national monuments in the area.

Trump cut the size of the Bears Ears and Grand Staircase-Escalante monuments in 2017, which created a firestorm of criticism from activists who said the president’s decision hurt Native American communities. read more
