Justice Anthony Kennedy – More Powerful than Any President

by: the Common Constitutionalist

Some say the President of the United States, no matter who that is at any given time, is the most powerful man in the world. As the Chief Executive of the United States, he commands both the largest and most powerful military, and also the largest and most powerful economy on the planet.

This may be true on the World stage, but it is not the case domestically. For years now, supreme Court Associate Justice Anthony Kennedy has been the most powerful person in America.

While this is an abomination of federalism, it is never the less true. And it’s something that seems to be thrown about as no big deal by the legal, political and pundit class. But it is a big ‘F’ing deal (h/t Joe Biden), yet has evidently become the new normal.

We have devolved from the Founders’ vision of three equal branches providing checks and balances on one another, to being ruled by nine black robed oligarchs, to now the reality we face today. That our freedoms and liberties, our economy – everything we hold dear, is controlled by a single individual.

In Justice Kennedy’s hands (or his vote), he holds the future of America. We have never been so close to a dictatorship as we are today. And by one who cannot be voting out, or otherwise removed. Like a dictator, it is he and he alone who decides to stay or go. But unlike a Dictator, there is little fear of assassination. read more

The New North Korean Threat

by: the Common Constitutionalist

Below are 2 videos of North Korean State-Run Tv. They are, as we have heard for years, quite threatening. It sounds like the same old bluster they used back in the 1990’s to fool the idiots (not hard to do) like former president Jimmy Carter and Madeline Not-All-that-Bright into them giving oil, and other supplies as well as assistance in building reactors. In return North Korea promised to freeze it’s nuclear weapons program. They promised, so we should’ve believed them. I think they did a pinky swear with Carter. About that same time the North Korean leader, Kim Il Sung died and his son, Kim Jong Il became supreme leader. Just as it is now, Kim Jong Il was new and untested and had to make his presence known and flex his leadership muscles. Many in this country and worldwide thought that with the passing of his father, the son Kim Jong Un would be more reasonable and receptive to peace and compromise. Of course, as it is with all tin-pot depots, it is turning out, at least so far, to be the exact opposite. What a shocker! Who would’ve seen that coming?

Despite the rhetoric of the interviewed citizen, one can hardly blame the people of North Korea. They no nothing of the world outside their own country. They have been thoroughly brainwashed for decades.

The problem is, as I see it, with each successive hand-down of power from one Kim to the next, North Korea becomes a little more unstable and the leader becomes lunier. This kid, Kim Jong Un, is most likely certifiable. He is a spoiled child of a ruthless dictator that has never heard the word “No”. He’s probably never lost at anything, due to the fear of death for anyone stupid enough to tell he has lost. Not to mention, he was kept under wraps for most of his life. No one outside North Korea even knew he existed until about a decade ago.

I’m not convinced this guy is just all show and no go. He may be crazy enough to do something. Who is going to tell him he can’t launch a nuke?

Now he is tearing up and invalidating the 1953 Armistice between North and South Korea. That’s nothing new; it’s been done before, just to be reinstated.

But I fear this guy may be different. He may actually roll into South Korea. Then what? What will we do? What will China do, or Russia? Will we be willing to sacrifice 58,000 American troops to protect our ally, South Korea. Think of all the Hyundais and Samsung products that could be lost.

Seriously, what would we do? I frankly don’t have a clue, especially with our current leader who specializes in leading from behind.

How to Preserve a Dictator

How Do You Keep A Dead Political Leader Fresh For Public Viewing?

The death of Venezuelan president Hugo Chavez has been met with mixed feelings here in the US. But he was adored in his country, at least by those who didn’t despise him, so after his death, his vice-president, Nicolas Maduro, stated that his body would be embalmed “like Lenin and Mao Zedong,” and displayed for a week.

But how do you display a body for an entire week?Hugo Chavez

The Ugliness of Death

Decomposition begins from the second of death in human bodies. The first stage of decomposition, called the “fresh” stage, begins when the heart stops beating. Blood stops pumping to the extremities and settles due to gravity, causing the skin to become bluish-purple. After a few hours, rigor mortis kicks in. At the same time, the body begins the process of autolysis, in which pH changes in the body trigger the structural breakdown of cell walls. Those cells release digestive enzymes which completely destroy the cell. And while all that is going on, aerobic bacteria in the body are gobbling up all of the oxygen that remains inside, but since there’s no new oxygen coming in, they soon die off, leaving a perfect space for anaerobic bacteria to jump in. They start chowing down on any liquids and fats in the body and producing nasty stuff–gases, acids, that kind of thing–which turn into bloat. And that’s not even accounting for visible insects like blowflies.

The type of embalming performed at funeral homes is temporary, designed to last a mere few hours until the body can be buried. Embalming is an ancient practice, with cultures as widely varied as the Inca, the Egyptians, and the Han Dynasty Chinese all having traditional embalming methods and ceremonies.

Today, this kind of temporary preservation is usually done by arterial embalming. Blood and other fluids are drained from the body, and an embalming solution is then injected with a pump into an artery–typically the right carotid artery, in the side of the neck–while the embalmer massages the veins and extremities to circulate the fluid throughout the body. The embalming solution is mostly common solvents, with formaldehyde and methanol being typical ingredients. Other ingredients could include phenols (which serve the same purpose as formaldehyde–and also smell like scotch whisky), water, a conditioner to balance the pH of the water, and some kind of pink or red dye to maintain the color the body was when it was less…dead.

This solution denatures the proteins of surrounding cells, which has the dual purpose of killing any bacteria and also making those cells worthless as food for any bacteria that would try to settle in. It’s kind of grotesque, but you can think of this like a ceviche, in which acid denatures the proteins of delicious seafood, thus sterilizing it. (Sorry for that comparison.)

But this only preserves the body for a little while–plenty of time to perform an open-casket funeral service, but if you want to display a communist national leader for a week, you’ve got to try something else. And what if you want to do it for more than a week? Lest we forget, the body of Vladimir Lenin has been on display since his death. Which was in 1924.

Lenin's Body

Long-Term Preservation

Vice-President Maduro specifically said that Chavez would be embalmed like Lenin, rather than preserved through any other method (more on those later). And luckily, we have some information on how Lenin’s body was preserved. And it’s not wildly different from short-term preservation. You need to invest in more hair and makeup, because hair falls out fairly quickly, but the big difficulty is moisture.

The alcohol, for example, is highly important to the embalming process. It’s what’s used to hold the formaldehyde in solution, since you’re trying to stay away from water–but alcohol evaporates quickly, which can lead to the body drying out. So you have to keep the humidity level fairly high, to combat that. But keeping the humidity level high invites all sorts of other critters–mold, fungus, bacteria–that thrive in damp environments. It’s a constant balance between wet and dry. Ilya Zbarsky, in a 1999 interview to the BBC, stated:

Twice a week, we would soak the face and the hands with a special solution. We could also improve some minor defects. Once a year the mausoleum was closed and the body was immersed in a bath with this solution.

This preserves Lenin’s body…adequately. His face looks very waxy and shiny; it’s clear it’s Lenin, but nobody would mistake his century-old body for a man taking a nap.

What About More Modern Techniques?

Ah, here’s where we get into some interesting stuff. In 1979, a German anatomist named Gunther von Hagens applied for a patent for a process he called “plastination.” Plastination, in brief, replaces all of the liquids and fats (these are the problematic materials, decomposition-wise) in a body with plastics. It’s a more difficult and newer technique than traditional embalming, but it has lots of advantages. Bodies preserved by plastination do not decay at all; no need for the kind of repeated upkeep Lenin’s body needs. They’re completely sterile, so you can even touch them without risk. And, perhaps best of all, you’re not fighting decomposition: plastinated bodies are perfectly preserved in the moment they were treated, including color and appearance. If you’ve seen the Bodies exhibit that tours from museum to museum, this’ll be familiar–that exhibit consists of plastinated body parts.

Plastination

Plastination: A newborn in the process of plastination. Wikimedia Commons

Here’s how it works. First, you inject with formaldehyde, much like you would to embalm. But the formaldehyde in this case is only used to preserve the body during the plastination process, and to lessen rigor mortis so the body can be posed as desired. Then, to draw out all the liquid–remember, liquid is the enemy here–the body is immersed in a bath of acetone, a clear, odorless compound that, when very cold, draws out water from the body and takes its place. Acetone might be a weird and highly flammable substance, but one thing it is not is a friend to mold or bacteria.

Then, you take the body and immerse it in a second bath, this time a common polymer like silicone rubber, polyester, or epoxy resin. Then you bring it to a boil–I know, this sounds like a horrifying recipe–and the acetone will evaporate from the body’s cells, at which point the polymer will move in and take its place. Then you zap the whole thing with an ultra-violet gun to dry and harden the plastic, and congratulations, you’ve got a plastinated body.

What About Freezing?

Well, basically, no. Cryopreservation is a young and controversial technique to maintain cells by keeping them at extremely low temperatures–like, several hundred degrees below zero. It works, kind of, but only for very small and simple creatures like tardigrades (AKA water bears), or for small human cells like sperm cells or embryos. It works well for that stuff; embryos have been preserved for up to 16 years and thawed successfully. But for larger human tissue, cryopreservation is just too immature and ill-understood. There are all kinds of problems: cells sometimes begin to form ice crystals or begin to dehydrate, which can cause irreparable physical damage to the cell walls. But research is definitely progressing in the field.

So, Chavez will be embalmed. Embalming is a classic! But perhaps the next controversial freedom fighter/despot will opt for plastination.

World Leaders for Barack

by: the Common Constitutionalist

Over the past several months, President Obama has been amassing the support of famous world leaders and other international notables (not to mention Hollywood Mensa members like Eva Longoria).

Well, I for one, think that’s terrific. It’s great to hear the rest of the world has as much confidence in our dear president as we do.

It’s not often, nor conventional, for foreign dignitaries to do such a thing. Most world leaders prefer to stay neutral so that they might have an opportunity to work with whichever side emerges victorious.

But these bold leaders are different. They choose not to “sell out” to convention.

So who might these world leaders be, you ask?

Well, there’s Venezuela’s Hugo Chavez, who, just recently, assured us he’d vote for Obama if he were from the United States. The America-bashing dictator made the announcement on state-owned television, saying “Obama is a good guy” and that if Obama was from Caracas, he’d surely return the favor by voting for Chavez.

Actually Hugo could just catch a flight into Los Angeles the morning of November 6th, cast his ballot (several times, if he so chooses) and catch the next flight back to Caracas.

Earlier in the year the government-official daughter of Cuban military dictator Raul Castro proclaimed her country’s support for Obama during a visit to the U.S. “I believe that Obama needs another opportunity and he needs greater support to move forward with his projects and with his ideas, which I believe come from the bottom of his heart,” Mariela Castro said during a cable news interview.

I agree that they come from the bottom of something.

Was the word “Forward” used intentionally or, in the words of the later painter, Bob Ross, ” just a happy accident”?

“Forward” is the official Obama re-election slogan and, if you recall, “forward” was also a well-known communist slogan. You may read about it here.

Putin called his U.S. counterpart “a genuine person” who “really wants to change much for the better.” Speaking to Russia’s state-run RT television channel, he said a second Obama term could help solve disputes over missile defense. By “solving” disputes, he means, we would unilaterally disarm, as Obama is already doing and Vlad would retain all Russia’s arsenal by not cutting their nuclear warhead stockpile. There, dispute solved.

As an aside; how come Obama can’t have a state-run television network like his contemporaries? Oh wait, he does. NBC, ABC, CBS, etc.

And why shouldn’t Puty Pute endorse Barack, after the now infamous chat between Obama and then president Dmitri Medvedev, where Barack told Dimitri, ” This is my last election. After my election, I have more flexibility”. Dimitri then reassures Obama, ” I understand. I will transmit this information to Vladamir”.

Mahmoud Ahmadinejad, the benevolent president of Iran favors Barack over Mitt.

The French Socialist leader is a fan of Barack, yet the famous freedom fighter from Poland, Lech Walesa is not. He is supporting Mitt Romney. Lech probably just wants to take away Polish womens’ right to contraception, like Mitt. What a jerk.

United Nations special rapporteur (investigator) on counterterrorism and human rights Ben Emmerson came out and took aim at Republican candidate Mitt Romney on Friday telling The Canadian Press, “There is no doubt that the Romney administration would be able to claim — in the event of a Romney presidency — a democratic mandate for torture.” “That would put Romney as the first world leader in history to be able to claim a democratic mandate for torture,” Emmerson said. This is the same Emmerson who helped defend the radical cleric and terrorist Abu Qatada, as well as other terror suspects. Sounds like an Obama endorsement to me.

All these stalwarts of the free world endorsing one man. Barack must be so proud. After all, he says he favors coalition building and what a great one he has built.

Seriously, how is it these evil people all support the same American candidate? Does this not tell us something?

It would be like Charles Manson, Jeffrey Dahmer and O.J. all supporting the same person for Chief of Police. You know, the one who arrests the bad guys. Would that not be strange?

Would you not think, if these evil criminals are supporting the same individual as am I, at the very least, should I take another, more critical look at my candidate?

Brotherhood Taking Total Control of Egypt

Has anyone, anyone at all, gone back and asked the wizards of smart what they make of their sacred “Arab Spring” now?

I’ve been publishing a lot of articles regarding the middle east and in particular, Egypt. There’s a reason for it. Egypt has always been a major player in the middle east. As Egypt goes, so goes the region, so goes Israel and so goes our vital interests in that part of the world. It’s not just Iran and certainly not Syria folks.

While the world persists in looking for signs of pragmatism in the Egyptian president, Mohamed Morsi is quietly taking over all the power bases in the country.

Having gotten rid of the army old guard, he replaced them with his own men – officers belonging to the Muslim Brotherhood or known sympathizers. Then he turned his attention to the media, replacing 50 editors working for the government’s extensive and influential press empire – including Al- Ahram, Al-Akhbar, Al-Gomhuria. He is now busy appointing new governors to the 27 regions of the country.

Hosni Mubarak used to choose retired generals he could depend on for these sensitive posts; Morsi is hand picking party faithful. At the same time upper echelons in government ministries and economic and cultural organizations are methodically being replaced. The Muslim Brotherhood is fast assuming total control. For many observers, the deployment of army units in Sinai is more about proclaiming Egyptian sovereignty in the face of Israel than actually fighting Islamic terrorism.

Drafting the new constitution is their next objective. Brothers and Salafis make up an absolute majority in the Constituent Assembly. Liberal and secular forces are boycotting its sessions, and the Supreme Constitutional Court is examining a request to have it dissolved since it does not conform to the constitution because of its overly Islamic composition; a decision is expected in September.

The assembly, however, is not waiting. According to various leaks, it is putting the final touch to a constitution where all laws have to conform to the Shariah and special committees will supervise the media and forbid any criticism of Islam and of the Prophet. In the wings, is the creation of a Committee of Islamic Sages supervising the law-making process and in effect voiding of substance the parliament elected by the people, though it is not clear yet if, when and how it will work. What is clear is that a parliament made of flesh and blood individuals is against the very nature of the Shariah, where all laws are based on the Koran and the hadiths. This is a far cry from the Universal Declaration of Human Rights.

Morsi has been careful to speak about creating “a civil society”; it is now obvious that what he meant was a society not ruled by the army, and not a secular society. Indeed he had promised to appoint a woman and a Copt as vice presidents, but chose Mohamed Maki, a Sunni known for his sympathy for the Brotherhood and incidentally or not, the brother of the new minister of justice, Prof. Ahmed Maki, known for his independent stands and opposition to Mubarak, but who had carefully concealed his support for the Brothers.

It is worth stressing that the Brotherhood is still operating under conditions of utmost secrecy, as it had been doing during the decades of persecution. How it is getting its funds, who are its members and how they are recruited is not known, nor is its decision-making process. The movement has no legal existence since Gamal Abdel Nasser officially disbanded it in 1954.

That state of affairs was not changed while the Supreme Council of the Armed Forces ruled the country, since apparently the movement did not apply for recognition, fearing perhaps it would have to reveal some of its secrets. Now that it has created its own political party, that the members of that party make up nearly 50 percent of the parliament and that one of their own has been elected president, can the movement remain in the shadows?

Morsi did announce that he was resigning from the Brotherhood, but there is no doubt that he will remain true to the tenets and the commands of its leaders. This is making people increasingly uneasy. They had other expectations of the revolution.

Opposition to an Islamic regime is growing, though it is far from being united. The three small liberal parties that had had very little success in the parliamentary elections have now set up a new front, The Third Way, to fight the Brotherhood’s takeover. Hamdeen Sabahi, leader of the nationalistic Karama (Dignity) Party, who had garnered 18% of the votes in the first round of the presidential election, has launched “The Popular Current” promoting the old Nasserist pan-Arab ideology.

Some of the nongovernmental media are vocal in their criticism of Morsi, though it can be costly: Private television station Al- Pharaein – “the Pharaohs” – was shut down after it called to get rid of Morsi; its owner, Tawfik Okasha, well known for his hostility to the Brothers (and to Israel) and who called for a massive demonstration this Friday, was put under house arrest, as was the editor of the daily Al-Dostour that had criticized the president. The editors of two other dailies – Al-Fajer and Saut el-Umma – were questioned. Other papers such as Al-Akhbar stopped publishing opinion pieces from their regular collaborators known for their opposition to the Brothers; well-known publicists left their page blank in a gesture of solidarity for their colleagues.

Morsi knows that his takeover will strengthen the opposition. He has not forgotten that he barely mustered 25% of the votes in the first round of the presidential election – down from the nearly 50% who voted for his party’s candidates in the parliamentary elections. He also knows that the people are no longer afraid to take to the streets to protest – and that it is now said that a new dictatorship is replacing the old – the only difference being that the new ruler has a beard….

However, for now he is devoting all his energy to his fight with the judiciary, long known for its independent stands. The Supreme Constitutional Court is being asked to rule the Brotherhood Movement illegal, and therefore to proclaim that the Liberty and Justice party it created – and which won 50% of the seats in the parliament – is illegal as well, and therefore to invalidate the election of Morsi, candidate of a movement and a party that are both illegal. Morsi sent his new justice minister to browbeat the court, but the judges refused to back down. The president is now working to limit the prerogatives of the court in the new constitution and will start “retiring” senior justices appointed by Mubarak.

Friday’s demonstration will be the first real test for the Brotherhood. It is taking no chances and security forces will be deployed around its institutions throughout the country. A cleric at Al-Azhar issued a fatwa calling for the killing of whoever protests against the rule of the Brotherhood; the resulting uproar was such that he was disavowed by some of the leaders of the movement. However, whatever happens Friday will not deter them from their goal – a thoroughly Islamist Egypt.

2012 Voting Rights Act

by: the Common Constitutionalist

Step one in the great election theft of 2012. Through an illegal dictatorial decree (executive order), the Obama Administration will grant amnesty for young illegal immigrants. They won’t call it that but who cares.

This of course is beyond the scope of the president’s constitutional authority. That is of no concern to him or the revolutionaries that surround and advise him. The plan is to immediately stop any deportation efforts and issue work permits to these young lawbreakers. They will attach some pretend conditions on the illegals to make it sound more reasonable. (eg: must have graduated high school.) In order to comply with the federal program, the illegals will, no doubt,  have to register with Homeland Security.

During a press conference in 2011, the president clearly explained to the press & public, he did not have the authority to just change or disregard the laws regarding illegal immigrants.

They have evidently found a way to just usurp congress & decree it, just as you would expect a dictator to do. Actually, they haven’t found a way around our pesky laws. The administration just doesn’t care. They do these sorts of things all the time, just daring the congress to stop them. Also, in 2011 they didn’t think they would need this block of non-citizens.

Obama explained his reasoning this way: He sent a proposal to congress and they blocked it. He just can’t wait for their approval, so in true constitutional form, he has decided to make it so without congressional approval. He did assure the American people, this would not be a path to citizenship. Although I don’t believe him, I do believe they don’t care whether these poor folks are citizens or not. That is not what they’re after.

I do agree, however, that he can’t wait. It will, after all, take time for all the illegals to sign up for the program.

The Obamites must leave themselves enough time to implement Step two.

Step Two will be a massive voter registration drive. By shear coincidence, these young illegals just happen to be between the ages of 18 & 30. Just old enough to vote & young enough to still be stupid.

As you recall, all of the young illegals had to sign up for work permits. To do so required them to release to the government, their personal contact information including an address and telephone number.

In a way that doesn’t seem possible, these lists will somehow end up in the hands of the “Center for American Progress”, “MoveOn.Org” and/or some “ACORN” type organization.

These organizations will then fan out across the nation to register the unsuspecting voting block. Strong-arm tactics will NOT be used for the registration drive. Threats of deportation will NOT occur, for those who balk at registering to vote, because the new worker knows it is illegal to do so, . There will be NO incentive proposed for registration, such as free sign up for Obamacare.

As I stated, in 2011, Obama said that he simply didn’t have the authority to do this, he was not a Monarch. So what has changed? Certainly not the whole “Monarch” thing. He has always thought that. What has changed is the need for additional votes.

The administration knows it is in real electoral trouble. This leads me to reveal Step Three.

My theory is that they will cheat as much as they have to, to win the popular vote in November. As you may know, whoever wins the electoral vote, wins the election. If Romney wins the electoral vote but Obama can pull out a popular vote victory, his administration and wacko supporters will file so many lawsuits it would cause the country to shut down, not to mention, tearing it apart by fomenting race riots. There have been many factions in the past wanting to just do away with the whole electoral process & replace it with the popular vote only. Hillary Clinton suggested it several years ago.

I guess we’ll just have to see how much congress let’s Obama get away with. I hate to say it, but most of them don’t have the spine to do the right thing and stand up to this bunch.

But, with enough independent light shone on the administration, it may at least, slow them down and possibly wake up a few more legal voters.

Just Another Peaceful Gathering

From Common Constitutionalst contributing writer, Beverly Smith:

Why does the left always resort to violence, vandalism and mayhem?

On Saturday, in Oakland, the peace loving occupy wall streeters took to the streets and city hall, reeking havoc for the police, citizenry and government officials.

Naturally the taxpayers will, once again, be stuck with the cleanup bill.

They burned flags, smashed glass and scrawled graffiti. Why? No one ever asks why. What’s the point they are trying to make with the violence?

Didn’t they tell the world, when the movement began last summer, their protests would be peaceful? I swear I read that somewhere, way back when.

The mayor of Oakland, Jean Quon, is now at her wits end. She has called for an end to the violence saying, “Stop using Oakland as it’s [OWS] playground.”

Can you imagine if kids acted like this at a real playground?

That’s a marked change from her unwavering support of the movement in October(2011).

At the protests inception Quon said, “We support the goals of the Occupy Wall Street movement: We have high levels of unemployment and we have high levels of foreclosure that makes Oakland part of the 99% too. We are a progressive city and tolerant of many opinions. We may not always agree, but we all have a right to be heard”.

Tolerant of many opinions, eh. I wonder what opinions they wouldn’t tolerate? That was a rhetorical question.

Now that the OWS crowd has predictably turned violent, Quon says, “People in the community and in the occupy movement have to stop making excuses for this behavior.”

So also must all government officials everywhere, as well as the media.

The OWSers actually had the nerve to criticize the behavior of the police! Isn’t that rich?

Of course, what we do hear is dead silence. Nothing from our fearless leader Obama, Pelosi (her home state), Eric Holder, etc. Where’s governor Moonbeam, Jerry Brown?
Mayor Quon is left dangling in the wind and the more deafening the silence becomes, the more emboldened the protesters become.

Chaos is just what the left truly wants. Let the violence escalate, suspend habeas corpus, declare martial law and Obama becomes dictator.

Maybe I just answered my own question. After all, some of the originators of this movement are confidants of “The One”.
